Lawsuit Against Biden Administration’s Student Loan Bailout Plan
On October 10, 2022, the JCN Foundation Legal Action Fund filed a lawsuit with the U.S. District Court for the Northern District of Texas to block the Biden Administration’s student loan bailout plan to forgive over 40 million recipients of student loans. The Foundation claimed the bailout plan “violates the Administrative Procedure Act’s basic notice-and-comment procedures for regulations.”2 On November 10, 2022, U.S. District Judge Mark Pittman of Northern Texas blocked the bailout by ruling in favor of the JCN Foundation’s plaintiffs Myra Brown and Alexander Taylor and calling the bailout plan “unlawful.” 3 On December 1, 2022, the 5th U.S. Circuit Court of Appeals, based in New Orleans, ruled unanimously to reject the Biden Administration’s request to lift the suspension placed by the Northern District Court in Northern Texas while ruling to “expedite the case in its docket to the “next available” oral argument.” 3
